Iranians around the world (“IAW” or “we, our, us”) is a website to give people (mainly Iranians also known as Persians or in general Farsi speakers) an opportunity to build communities and work together to advance Iranians worldwide. Iranians will have opportunities to create their own blogs, to share their knowledge with others, to introduce their businesses (products and services), and communicate with other Iranians globally. Our mission is to create an authentic, interesting, and informative social platform for Iranians helping them to thrive across countries. We (Iranians around the world) hope you help us in our mission to build an authentic online community. We encourage you to post your experience, or create your own blogs, and share your knowledge with others to participate in Iranians’ cultural and financial growth. To create a community where users can interact openly and authentically with others and explore new ideas, everyone should have an expectation of privacy and safety. It can only exist if we operate by a shared set of community standards that outline what is and is not allowed on IAW. Our policies are based on the advice of experts in the fields such as technology, public safety, and human rights.
By accessing or interacting with our servers, services, websites, mobile app, or any associated content/postings in IAW website, you agree to these terms and conditions (T&C) (last updated Oct 12-2022). You acknowledge and agree IAW is a private site owned and operated by IAW. If you are accessing or using IAW on behalf of a business, you represent and warrant to IAW that you have authority to accept the (T&C) on behalf of that business and that business agrees to the (T&C). If you do not agree to the (T&C), you are not authorized to use IAW. We may modify the (T&C) at any time in our sole discretion. You are responsible for periodically checking for changes and are bound by them if you continue to use IAW. Our privacy policy and all other policies, site rules, and agreements referenced below or on IAW, are fully incorporated into this (T&C), and you agree to them as well.
Access to the service:
- Sufficient age and capacity to use IAW are required by the law of your country of residence to access and use the service. No one under 13 or the minimum legal age of your country are allowed to use or access the Services. IAW is registered in California, USA as a C corporation.
- If you are accepting these Terms on behalf of another legal entity, including a business or government entity, you represent that you have full legal authority to bind such entity to this (T&C).
- Unless licensed by us in a separate written or electronic agreement, you agree not to use or provide software (except our App and general-purpose web browsers and email clients) or services that interact or interoperate with IAW, e.g., for downloading, uploading, creating/accessing/using an account, posting, flagging, emailing, searching, or mobile use. You agree not to copy/collect IAW content via robots, spiders, scripts, scrapers, crawlers, or any automated or manual equivalent (e.g., by hand). Misleading, unsolicited, and/or unlawful postings/communications/accounts are prohibited, as is buying or selling accounts.
- You agree not to post content that is prohibited by any of IAW's policies or rules referenced above ("Prohibited Content"). You agree not to abuse IAW's flagging or reporting processes. You agree not to collect IAW user information or interfere with IAW.
- You agree we may moderate IAW access/use in our sole discretion, e.g., by blocking, filtering, re-categorizing, re-ranking, deleting, delaying, holding, omitting, verifying, or terminating your access/license/account. You agree (1) not to bypass said moderation, (2) we are not liable for moderating or not moderating, and (3) nothing we say or do waives our right to moderate, or not.
- Unless licensed by us in a separate written or electronic agreement, you agree not to (i) rent, lease, sell, publish, distribute, license, sublicense, assign, transfer, or otherwise make available IAW or our application programming interface ("API"), (ii) copy, adapt, create derivative works of, decompile, reverse engineer, translate, localize, port or modify the App, the API, any website code, or any software used to provide IAW, (iii) combine or integrate IAW or the API with any software, technology, services, or materials not authorized by us, (iv) circumvent any functionality that controls access to or otherwise protects IAW or the API, or (v) remove or alter any copyright, trademark or other proprietary rights notices. You agree not to use IAW or the API in any manner or for any purpose that infringes, misappropriates, or otherwise violates any intellectual property right or other right of any person, or that violates any applicable law.
Your IAW Account and Account Security
To use certain features of our Services, you may be required to create an IAW account and provide us with a username, password, and certain other information about yourself.
You are solely responsible for the information associated with your Account and anything that happens related to your Account. You must maintain the security of your Account and immediately notify IAW if you discover or suspect that someone has accessed your Account without your permission. We recommend that you use a strong password that is used only with your Account.
we will never rent, sell or disclose your personal/business information to any third party (except the trusted third parties who assist us in operating our site) without your prior written consent unless we are required to do so by a court or a public authority (USA federal law) or we reasonably conclude that such disclosure is necessary to protect the rights, property or safety of IAW, our website, or the users of our website.
Paid Services and Payment Information
There are no fees for the use of many aspects of the Services. However, some services, including advertising (introducing their product and services), selling arts, and educational courses (Farsi language classes, Persian calligraphy, paintings) are available for purchase (“Paid Services”). When you make a paid posting, you authorize us to charge your account. Any tax is additional for purchasing artworks.
- Refund policy: Fees are refundable only for the educational courses within 30 days of purchase in the United Sates and Canada. International orders outside of the US and Canada are final sale. Fees are non-refundable for other services purchasing artworks and advertising in the US and outside of the US, even for posts we remove, delay, omit, re-categorize, re-rank, or otherwise moderate. We may refuse any posting.
IAW may change the fees or benefits associated with the Paid Services from time to time with reasonable advance notice of material changes; provided, however, that no advance notice will be required for temporary promotions, including temporary reductions in the fees associated with the Paid Services. Notwithstanding the foregoing, any price changes or changes to your subscription plans will apply no earlier than 30 days following notice to you.
You may submit your debit card, credit card, or other payment information (“Payment Information”) via our Services to purchase the Paid Services. We use third-party service providers to process your Payment Information. If you submit your Payment Information, you agree to pay all costs that you incur, and you give us permission to charge you when payment is due for an amount that includes these costs and any applicable taxes and fees. All transactions are final for advertising and purchasing artworks. We do not refund or credit for partially used billing periods.
Trademark and Intellectual Property
IRANIANS AROUND THE WORLD (IAW) is registered in California, USA as a c-corporation and the peace symbol logo are registered trademarks with the U.S. Patent and Trademark Office.
The Services are owned and operated by IAW are protected by intellectual property and other US federal laws including the visual interfaces, graphics, design, compilation, information, data, computer code, products, services, trademarks, and all other elements of the Services (“Materials”) provided by IAW. All Materials and artworks included in the Services are the property of IAW. You acknowledge and agree that you shall not acquire any ownership rights whatsoever by downloading Materials or by purchasing the artworks. You may not make use of the Materials. IAW reserves all rights to the materials, data, posts, and the artworks.
DISCLAIMER & LIABILITY
To the full extent permitted by law, IRANIANS AROUND THE WORLD, and its officers, directors, employees, agents, licensors, affiliates, and successors in interest ("IAW Entities") (1) make no promises, warranties, or representations as to IAW, including its completeness, accuracy, availability, timeliness, propriety, security or reliability; (2) provide IAW on an "AS IS" and "AS AVAILABLE" basis and any risk of using IAW is assumed by you; (3) disclaim all warranties, express or implied, including as to accuracy, merchantability, fitness for a particular purpose, and non-infringement, and all warranties arising from course of dealing, usage, or trade practice; and (4) disclaim any liability or responsibility for acts, omissions, or conduct of you or any party in connection with IAW. IAW Entities are NOT liable for any direct, indirect, consequential, incidental, special, punitive, or other losses, including lost profits, revenues, data, goodwill, etc., arising from or related to IAW, and in no event shall such liability exceed $100 or the amount you paid us in the year preceding such loss. Some jurisdictions restrict or alter these disclaimers and limits, so some may not apply to you.
CLAIMS & INDEMNITY
Any claim, cause of action, demand, or dispute arising from or related to IAW ("Claims") will be governed by the internal laws of California, without regard to conflict of law provisions, except to the extent governed by US federal law. Any Claims will be exclusively resolved by courts in Ventura, CA (except we may seek preliminary or injunctive relief anywhere). You agree to (1) submit to the personal jurisdiction of courts in Ventura, CA; (2) indemnify and hold IAW Entities harmless from any claims, losses, liability, or expenses (including attorneys' fees) that arise from a third party and relate to your use of IAW; and (3) be liable and responsible for any claims we may have against your officers, directors, employees, agents, affiliates, or any other party, directly or indirectly, paid, directed or controlled by you, or acting for your benefit.
MISC
Unless you have entered into a separate written or electronic agreement with us that expressly references the (T&C), this is the exclusive and entire agreement between us and you, and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral. Users complying with prior written licenses may access IAW thereby until authorization is terminated. Our actions or silence toward you or anyone else does not waive, modify, or limit the (T&C) or our ability to enforce it. The USE, LIQUIDATED DAMAGES, and CLAIMS & INDEMNITY sections survive termination of the (T&C), and you will remain bound by those sections. If a (T&C) term is unenforceable, it shall be limited to the least extent possible and supplemented with a valid provision that best embodies the intent of the parties. The English version of the (T&C) controls over any translations.
